LIMITS TO THE RIGHT TO IDENTITY: THE ADMISSIBILITY OF THE OF CORPORAL COERCIVE MEASURES IN PATERNITY CONTESTATION PROCEEDINGS

RESUMEN: Como consecuencia de los avances científicos que se han dado desde el reconocimiento del ADN como célula inconfundible de la identidad biológica, los ordenamientos jurídicos han desarrollado normas que determinan la obligación de los emplazados a someterse a la realización de estas pruebas, bajo apercibimiento de tenerse por consentida la vinculación en caso de no someterse a las mismas.

En el presente artículo se explican los motivos por los que resulta contrario al objetivo de protección de derechos la aplicación de apercibimientos coercitivos de índole físico y el peligro que implicarían su diligencia en el afán de otorgar sustento a la sentencia dictada por el juez civil.

ABSTRACT: As a result of the scientific advances that have occurred since the recognition of DNA as an unmistakable cell of the biological identity, legal systems have developed regulations that determine the obligation of those summoned to submit to these tests, under penalty of having consented to the legal connection in case of not submitting to them.

This article explains the reasons why the application of coercive warnings of a physical nature are contraries to the objective of protecting rights and the danger that their diligence would imply in an effort to support the sentence issued by the civil judge.
