LA REMOCIÓN DE AUTORIDADES, UN DERECHO CIUDADANO CONTRA LA CORRUPCIÓN SIN ESTRENAR

REMOVAL, A CITIZEN RIGHT AGAINST CORRUPTION UNRELEASED

RESUMEN: La remoción, como derecho fundamental de control ciudadano según el marco jurídico peruano no registra desarrollo reglamentario ni doctrinario, llámese artículo científico o resolución que dilucide su práctica. Como mecanismo institucional existen algunos antecedentes históricos que el artículo explora y considera para su desarrollo.

Se ha elaborado un análisis jurídico e institucional sobre las implicancias de este derecho de control ciudadano aún sin aplicar desde una perspectiva diacrónica, a la luz del derecho nacional y comparado, realizando una evaluación objetiva con el fin de determinar la mejor manera de poner en práctica la remoción vigente como derecho fundamental y como mecanismo participativo.

Se determinó que, al igual que la revocatoria, es un derecho fundamental y una institución de control ciudadano, aún sin usar, que ayudará de forma relevante en la lucha contra la corrupción y la inepcia de las autoridades públicas, hoy desbordada. Sin embargo, se requieren algunas precisiones de carácter técnico con el fin de viabilizar, facilitar y mejorar su aplicación y accesibilidad para los ciudadanos.

ABSTRACT: The removal, as a fundamental right of citizen control according to the Peruvian legal framework, does not register doctrinal development, neither scientific article nor jurisprudence that elucidates its practice. As an institutional mechanism, there are some historical backgrounds that the article explores and considers for its development.

This article intends to make a legal and institutional analysis of the implications of this unused right from a diachronic perspective, in the light of national and comparative law, in order to carry out an objective evaluation in order to determine the best way to implement removal as fundamental right and as a participatory mechanism.

It was determined that, just as the revocation is a fundamental right and an institution of citizen control, still unused, it will help in a relevant way in the fight against corruption and ineptitude, today overwhelmed in the public administration. However, some technical details are required in order to make viable, facilitate and improve its application and accessibility for citizens.
