THIRD PART OF THE PROCESS: THE JUDGE IN A SYSTEM OF ORALITY

RESUMEN: Las funciones del juez nacen del derecho de las personas de un juzgador imparcial e independiente, la litigación oral traída con este nuevo código le traigo funciones que involucran al juez lo que le termina dando una posición más participativa en el proceso; pasando de ser un observador a un sujeto que actúa por intereses que pretende proteger, no se habla de derechos personalísimos, sino de los intereses del Estado peruano, mediante el poder de resolver conflictos que le ha conferido la población; por ello se verán figuras como la conclusión del proceso, gastos procesales y la búsqueda de la verdad como parte de los objetivos que él buscará.

ABSTRACT: The functions of the judge are born from the right of the people to an impartial and independent judge, the oral litigation brought with this new code brings functions that involve the judge, which ends up giving him a more participatory position in the process; Going from being an observer to a subject that acts for interests that it intends to protect, we are not talking about very personal rights, but about the interests of the Peruvian State, through the power to resolve conflicts that the population has conferred on it; for this reason figures such as the conclusion of the process, procedural expenses and the search for the truth will be seen as part of the objectives that he will seek.
