DESPROTECCIÓN DEL DERECHO A LA VIVIENDA EN LA LEGISLACIÓN LATINOAMERICANA

LACK OF PROTECTION OF THE RIGHT TO HOUSING IN LATIN AMERICAN LEGISLATION

RESUMEN: Esta investigación, ha tomado como antecedente investigativo el artícuo de Torres Diana y Ruiz- Tagle Javier (2019) denomiando “¿Dereho a la vivienda o a la propiedad privada? De la política pública a la informalidad urbana en el área metropolitana en Lima”, utilizando el metodo de comparativo de carácter descriptivo, obteniedno como resultado el determinar como se ha visto afectado el derecho a la vivienda en paises como Colombia, México, Argentina, Brasil y Perú, concluyendo en una clara desprotección del derecho a la vivienda, en su mayoría por intereses particulares, desnaturalizando el sentido del derecho a la vivienda, de una prerrogativa inherente al ser humano a un derecho de indole económico, el cual dependiendo de la necesidad se puede ser afectado sin posibilidad de contradicción.

ABSTRACT: This research has taken as an investigative background the article by Torres Diana and Ruiz-Tagle Javier (2019) calling "Right to housing or private property? From public policy to urban informality in the metropolitan area in Lima”, using the descriptive comparative method, did not obtain the result of determining how the right to housing has been affected in countries such as Colombia, Mexico, Argentina, Brazil and Peru, concluding in a clear lack of protection of the right to housing, mostly due to private interests, distorting the meaning of the right to housing, from a prerogative inherent to the human being to a right of economic indole, which depending on the necessity can be affected without possibility of contradiction.
