PROTECTION OF THE RIGHTS OF MIGRANTS AND REFUGEES FROM THE PERSPECTIVE OF THE INTER-AMERICAN COURT OF HUMAN RIGHTS

RESUMEN: Los derechos esenciales de la persona no se limitan a su calidad de nacional de un determinado Estado, sino que se basan en su naturaleza de verdaderos derechos humanos basados en la naturaleza propia del ser humano. Es por ello, que estos derechos merecen protección no solo por parte de la legislación nacional, sino que también merecen protección internacional. Este es el caso de los migrantes, los mismos que por diversos motivos salen de sus territorios nacionales, pero muchas veces sus derechos no son reconocidos, y, por el contrario, son atropellados, desconocidos y vulnerados de distintas formas.

ABSTRACT: The essential rights of the person are not limited to their status as a national of a certain State, but are based on their nature as true human rights based on the nature of the human being. That is why these rights deserve protection not only by national legislation, but also deserve international protection. This is the case of migrants, the same ones who for various reasons leave their national territories, but many times their rights are not recognized, and on the contrary, they are trampled, unknown and violated in different ways.
