EL POSITIVISMO JURÍDICO, Y SU INFLUENCIA EN EL DERECHO DE CONTROL CIUDADANO DENOMINADO REVOCATORIA DE AUTORIDADES EN EL PERÚ, EN TIEMPOS DE COVID 19

LEGAL POSITIVISM, AND ITS INFLUENCE ON THE RIGHT OF CITIZEN CONTROL CALLED   REVOCATION OF AUTHORITIES IN PERU, IN TIMES OF COVID 19

RESUMEN: El presente trabajo pretende establecer los efectos que tiene el Derecho positivo en un instrumento de control jurídico  ciudadano denominado Revocatoria, que tiene una importancia significativa en el desarrollo de la cultura ciudadana y democrática de un País, para ello primero analizaré la influencia del Positivismo jurídico, entendido como el conjunto de normas jurídicas que constituyen un ordenamiento jurídico vigente y positivo, el positivismo entonces debe ser entendido como un fenómeno jurídico que contiene derechos y deberes, ya que constituye una forma de imputación de determinadas consecuencias  jurídicas a ciertos supuestos de hecho establecidos, para posteriormente analizar dicho proceso de Revocatoria que se viene activando en el Perú, a través de la adquisición     de los Kits de Revocatoria, y así más adelante establecer las consecuencias jurídicas, sociales y políticas que serán importantes para poder entender la influencia del Positivismo en la Ley y procesos de Revocatoria, ya que el Estado es la personalización del Orden jurídico que es gobernado por autoridades Políticas en tiempos de Covid 19.

ABSTRACT: This paper aims to establish the effects of positive law in an instrument of citizen legal control called Revocation, which has a significant importance in the development of citizen and democratic culture of a country, for this I will first analyze the influence of legal positivism, understood as the set of legal norms that constitute a current and positive legal system, positivism must then be understood as a legal phenomenon that contains rights and duties, since it constitutes a way of attributing certain legal consequences to certain established factual assumptions, to later analyze said Recall process that has been activated in Peru, through the acquisition of the Recall Kits, and thus later establish the legal, social and political consequences that will be important to be able to understand the influence of Positivism in the Revocation law and processes a, since the State is the personalization of the Legal Order that is governed by Political authorities in times of Covid 19.
