DESAFÍOS JURÍDICOS A PROPÓSITO DEL DERECHO AL ACCESO A LA INFORMACIÓN PÚBLICA EN MATERIA DE SALUD

LEGAL CHALLENGES REGARDING THE RIGHT TO ACCESS TO PUBLIC HEALTH INFORMATION

RESUMEN: La Constitución Política de 1993 contiene partes que no pueden modificarse y que a nivel de la doctrina se denominan como “dogmática”, puesto que contienen prerrogativas esenciales para la protección de los derechos fundamentales de la persona, como el caso del derecho al acceso a la información pública en materia de salud. Son muchos instrumentos y antecedentes legales internacionales los que reconocen este derecho dirigido a construir una sociedad más democrática y transparente, tal es el caso, por el ejemplo, el Pacto de San José o el Pacto Internacional de Derechos Civiles y Políticos.

En este sentido, a partir de una revisión de la doctrina y jurisprudencia actual, se analizarán los diferentes matices que ostentan el derecho al acceso a la información pública en materia de salud, a fin de contrastarlo con una temática coyuntural, esta es, la adquisición de vacunas a propósito de la propagación de la covid-19.

Tal análisis evidenciará que, actualmente, existe la imperiosa necesidad de generar estándares más específicos respecto al contenido del derecho de acceso a la información en materia de salud, pues, tal y como se señalará más adelante, no existe una justificación constitucionalmente legítima que impida legítimamente a los ciudadanos a conocer el precio de la vacuna Sinopharm.

ABSTRACT: The 1993 Political Constitution contains parts that cannot be modified and that at the doctrinal level are called “dogmatic”, since they contain essential prerogatives for the protection of the fundamental rights of the person, such as the case of the right to access to the public information on health. There are many international legal instruments and antecedents that recognize this right aimed at building a more democratic and transparent society, such is the case, for example, the Pact of San José or the International Covenant on Civil and Political Rights.

In this sense, based on a review of current doctrine and jurisprudence, the different nuances of the right of access to public information on health will be analyzed, in order to contrast it with a conjunctural issue, that is, the acquisition of vaccines regarding the spread of covid-19.

Such analysis will show that, currently, there is an urgent need to generate more specific standards regarding the content of the right of access to health information, since, as will be indicated later, there is no constitutionally legitimate justification that legitimately prevents the citizens to know the price of the Sinopharm vaccine.
