LOS DERECHOS DEL INIMPUTABLE PENAL

RESUMEN: En nuestro país, al igual que en todo el mundo, los hechos ilícitos no sólo son cometidos por personas jurídicamente capaces, sino también, por aquellos llamados inimputables, personas que no tienen capacidad de discernimiento entre lo bueno y lo malo, por lo tanto no pueden ser juzgadas con el procedimiento común, ni tampoco se les puede aplicar una pena o sanción tal cual se aplica en los otros casos; sino que merecen un procedimiento diferente, luego de lo cual, se determina si es pasible de una internación preventiva, considerando el grado de peligrosidad del sujeto para con la sociedad. Todo lo cual se encuentra regulado en los artículos 75, 293, 294, 456 a 458 del Nuevo Código Procesal Penal. Si bien existe un grupo minoritario de casos; sin embargo, es importante verificar si el procedimiento regulado con el Código Procesal Penal, es el más idóneo y completo para la solución de estos casos o si exige de cambios o una mejor regulación, en especial, el fijar parámetros para regular y sopesar el estado de peligrosidad de los inimputables.

ABSTRACT: In our country, as in the whole world, illicit acts are not only committed by legally capable people, but also, by those called unimputable, people who have no capacity for discernment between good and bad, therefore not they can be judged with the common procedure, nor can a penalty or sanction be applied to them as it is applied in the other cases; they deserve a different procedure, after which, it is determined if it is subject to a preventive internment, considering the degree of danger of the subject to society. All of which is regulated in articles 75, 293, 294, 456 to 458 of the New Code of Criminal Procedure. Although there is a minority group of cases; However, it is important to verify if the procedure regulated by the Criminal Procedure Code is the most appropriate and complete for the solution of these cases or if it requires changes or better regulation, especially, setting parameters to regulate and weigh the state of danger of the unimputable.
