EL ESTADO CONSTITUCIONAL Y LA TRANSFORMACIÓN DEL DERECHO

RESUMEN: El presente trabajo pretende describir los cambios que viene atravesando el Derecho a partir de la vigencia del Estado Constitucional. Para lo cual, primero analizaremos el Derecho que aún predomina en nuestro sistema y el marco sobre el cual se ha consolidado, el Estado de Derecho; para luego abordar el tema del Estado Constitucional, y descubrir cómo su vigencia viene cambiando la estructura interna y la teoría del derecho, así como las prácticas judiciales.

ABSTRACT: This paper aims to describe the changes through the law comes from the force of the Constitutional State. For that, first we analyze the law still prevails in our system and the framework on which it has established, the rule of law; then address the issue of constitutional rule, and discover how your force is changing the internal structure and the theory of law and judicial practices
